From a title perspective, there are several items you need to address before you put your home on the market. Agency Title is happy to assist with any and all of these steps and services, to ensure a successful sale and closing.
Marketable Title
In order to convey your property, you must be able to provide “Marketable Title”. This means having a preliminary title commitment that will disclose any encumbrances or defects, which allows you to address them before the sale.
Closing
You must determine who will be preparing the closing documents needed to complete your sale once you have a buyer for your property. These documents include the HUD Statement, Escrow Agreements, and the Warranty Deed. This service should be in place before the sale, so you have the proper documents ready.
Deposit
You will need a third party to receive the earnest money deposit from the purchaser.

Depending on your transaction, a number of other documents may be necessary in order to complete your sale:
Sales Contract
Seller’s Disclosure Form disclosing the condition of the property
Lead-Based Paint Disclosure Statement
Smoke Detector Affidavit
Responsibilities of Sellers Under Residential Lead-Based Paint Hazard Reduction Act Disclosure
Title Services
Once you have sold your home, the following will need to be completed by a title company:
Validate and prepare payment of outstanding taxes to be charged or credited at the closing
Validate and prepare payoffs of outstanding mortgages and/or liens on the property
